The Economic Analysis of Law on the To-be-expired Food Sales and Supervision

Abstract

To-be-expired food sold in shops and supermarkets without supervision run the certain risks of the security of people’s lives and health. However, under the current legal system, it is very difficult for the supervision departments on food safety to take fruitful/effective supervision measures. This exposes the contradiction and conflict of legality and rationality in food safety supervision. From the point of Law and Economics, this study analyzes in detail the causes of market self-regulation failure towards business behavior in selling the approaching expired food and problems in government regulation. The study also puts forward the legal governance mechanism of dealing with selling approaching expired food in order to provide some guidance to the legislation of supervision of food safety supervision.
